We often ask ourselves, what has this country came to, especially when you take a look at the criminal justice system in referance to people of color. My name is Rufus Rochelle, presently incarcerated at Coleman Federal Correctional Complex-Low. I have been imprisoned 24 years and counting for conspiracy with intent to distribute 50 grams or more of crack cocaine. I was sentenced to 420 months with no chance of parole. I was never caught with a single grain of drugs, no wiretaps, no undercover buys, just hearsay evidence. Tell me is this justice?

I  like for the  world to know the federal government is holding
me in prison and i don't meet there statute as a title 18 922 (g) (1)
defendant. The statute say's you must have a prior conviction that
exceeds one year imprisonment, i don't have one so therefore i don't
meet the statutory threshold. The used a north carolina class (i) felony
in the indictment which was a 6 to 8 month probation sentence, you can
never exceed one year imprisonment for such a case. See Simmons v.
united states,649 f3d 237( 4th cir. 2011) see also supreme court  case
Rosend carachuri.

somewhere in this great nation sits a soul destined to spend decades behind walls and fences not far from him or her is one who has already accomplished this not too easy task. my wish is that the future of those who have emerged this machine remain cognizant of its appetite in order to inform the next generation that it need not be their future. my wish is that we who have logged decades already in the jaws of this beast with more decades in front of us be the example of a redeemed human. that we be the light to the world which illuminates that rehabilitation, in spite of the lack of federally fostered rehabilitation that it does still exist and it dos show itself in second and some times third chances which sadly the federal sentencing schemes seem to have destroyed. let the word go forth that we are  accountable beyond the decades of incarceration leveled upon us that we are worthy of liberty restored that we are a part of the human family who can and do bring change to the men and women we once were .

HER EYE'S WHICH ONLY SEE THE GOOD IN PEOPLE, WHILE BEING ABLE TO SHUN AN EVIL PRESENCE; HER BREATH OF VIEW, PROBITY AND DISCERNMENT, DESCRIBES HER DIVINE ESSENCE.

HER NOSE IS PERFECT, THE COLOR OF FINE BRASS, AND TO ACCEPT THIS IT MIGHT BE HARD; FOR SHE IS ABLE BY THE MERCY OF OUR LORD, TO SMELL THE SWEET SAVORS OF GOD.

THE LUSTER OF HER LIPS ARE NOT TO BE COMPARED TO THE IMMACULATE WORDS SHE SPEAK; THE TRUTH OF GOD WITH FIERY ZEAL, THAT NO SINISTER COULD EVER BREACH.

It is my belief that history will not treat this generation kindly. In the history of mankind no country has ever perpetuated a war against its own citizenry except the United States. On a daily basis I meet fellow convicts faced with the prospect of dying in prison due to a death-in-prison sentence for a non-violent drug crime. Imagine the prospect of waking up every day knowing that your only escape is death. This in my view constitute mental torture of the worst kind worthy of intervention by the United Nations or Human Rights Watch.

 What makes this issue more glaring is that the  Columbian purveyors responsible for exporting tonnage of kilograms into the United States can received no more than 30 years in prison while a young blackman accused of distributing more than 50 grams of crack cocaine(now 280 grams) faced a potential life sentence. The absurdity of such situtaion defies logic in a country that pride itself on human rights. If the United States can enter into a treaty with Columbia that under no circumstances will one of their nationals received a life sentence, why can't the United States afford the same respect to its own citizens. It stands to reason that there must be some ulterior motive we are unaware of.

Suffice it to say, this absurdity should be brought to the forefront and members of Congress be asked pointed questions as to the underlying reasons why this disparity in treatment. The public needs to be educated to the egrgious acts been carried out in their names.

The reality is, until corruption and criminal behavior at the lowest levels of government is stopped, you will never be able to deal with it at the highest levels. everyone is running around tripping over the Fast & Furious scandal... But the F & F is only allowed to happen because lower-level corrupt practices are tolerated and not resolved until the stench reaches too high for deniability, and then there's accountability... At this facility, which is a maximum security penitentiary, there are incidents of correctional staff using inmates as their own personal hit squads... There is the almost daily embezzlement of taxpayer funds into the pockets of correctional employees... There are correctional staff at this facility who do not have the mental capacity or stability to handle the responsibility of the job, and so their actions are constantly being swept under the rug... Of these are C.O. Stonebraker, C.O. Sims, C.O. Demis(who commited suicide after his actions could no longer be hid), C.O. Gilbert, Lt's Crooks and Brice... All these individuals are abusing their authority on a daily basis and it will not be dealt until someone is killed behind their behavior... I know this will never get printed because people mhave no real desire to know the truth when it comes to things like this... but there it is...

I am currently serving a 360 month sentence.  DEA placed a GPS device on my vehicle WITHOUT A WARRANT.  The device immediately sent minute-to-minute pings to a DEA server that operates over an internet connection at anytime.  Through these minute-to-minute warrantless searches, shaped the DEA investigation into my being a primary target.  Based on daily warrantless searches, DEA then executed several administrative subpoenas obtaining phone records for several phones of suspected targets.  Administrative subpoenas DO NOT require a warrant.  It is a benefit of the Electronic Communications Privacy Act (ECPA), allowing DEA to obtain all incoming/outgoing calls and cell site location?switch information.  As the investigation gained momentum through continuing warrantless GPS searches, all my email records, my space records, credit reports from all three agencies, and phone records (including cell site location/switch info) also WITHOUT A WARRANT.  DEA then applied for and were granted the use of (NOT through a warrant based on probable cause, but rather a so-called "specific and articulable facts" standard that the number sought by the Government entity is relevant/material to an ongoing investigation...again part of the ancient ECPA) multiple pen register and trap and trace devices for several phones of suspected targets that provide all incoming and outgoing calls, cell site location information, and GPS coordinates of the phones in real time.  Shortly thereafter, DEA applied, and were granted orders for several Title III wiretap authorizations through the Department of Justice in Washington DC.  based on its warrantless fishing expedition.  Following weeks of intercepted communications DEA executed several arrests.

      The US Attorneys office entered into cooperation agreements with any defendant who agreed to cooperate against any other defendant who's attempted to prove innocence.  Even knowing the "proffers given by these defendants were extreme exaggerations or blatant perjury, the US Attorneys Office encouraged, orchestrated, and manipulated these fabrications to convince a jury to convict.  Mid-trial, it was even proved that several of these defendants were not being truthful.  As a precaution to save its case and in a desperate effort, the US Attorneys Office then used the Attorney General's power of immunity promising (off the record) a defendant who had not cooperated with the US Attorneys Office a lesser sentence in exchange for testimony it knew to be exaggerated.  Only then did that defendant agree to testify and testified that he was not promised a lesser sentence to the jury, but yet after several convictions, the US Attorneys Office recommended through a motion to the Court for a lesser sentence for that defendant pursuant to 18 U.S.C. Rule 35(b)...

Troubling Times Out Colorado"
A lot of law maker's and civilians will say that, guns are a terrible problem in our society. However, what took place at Century 16 movie theater in colorado, many would view this act as an criminal intent/act what have you.. But, for a 24yr old to disply such an act, its beyounf criminal... ITS MENTAL!! As a federal inmate, I watch as buses pulls up daily to drop of inmates, ages 18-24 are mental impared.. Suffering from depression/dimentia. A lot of our children today are sick(mentally) And the sad part about it is, us as parents are doing a poor job in raising our children. We are not vigilantenough in there behavior, to see if there is early signs of trouble that, will play out, in a criminal act like the one displayed in colorado..

When you think of a 24yr old, you think college, working, dating women etc Pulling, mass murders like this!! It has to be something in the home, not the water.... Its not up to the law makers to father/mother our children at the end of the day.. We have to do this! We were all born innocent children, what happen to our innocense? Its sad what took place in colorado and I speak for the guys at fairton federal institution, a lot of guys are sadly hurt.. And its not a white thing.. So many of us say, only a white person will do something like this. Its our problem as human beings.. Know one wants to live, acording to gods way of living.. We wanna kill, get high, indulge in crime, commit adultry etc. This world in going straight to hell in a paper bag.. No tough on law is helping either.. Hello, I was just thinking about the shooter at the Batman movie. If the town decided that he should not get the death penalty then he would end up serving his life in prison without parole. My name is Timothy Tyler with a federal prison number of 99672-012. I was arrested in 1992 and charged with Conspiracy to distribute LSD. I plead guilty for some private reasons and was sentenced to Life in federal prison which means that I must die in prison. So here it is twenty years later. I am in prison serving life. So I wonder if shooting all those innocent people is no worse than what I did. I sold 13 Sheets of paper with LSD on them. Perhaps it is time for the American public to reconsider what is a serious crime. I was featured on the Stossal show thanks to Julie Stewart from FAMM (Families Against Minimum Mandatory's). They were showing several people that are incarcerated in this country including me last week on Fox Business. I am now gay since it is said that without affection people go crazy. Pictures of me can be seen on a website some people started for me called Gratefultruth.com.  I am a non violent avid Grateful Dead fan. I wonder if you as the public agree that I should have the same sentence as a massive Killer. If not then perhaps signing on to support a clemency for me would be more appropriate.

Crazy and Unreasonable Punishment
I am a Federal prisoner.  I am a bank robber, a carjacker, and a gun criminal.  These things are all true.
I am a son, a brother, and a friend.  I am a college graduate, a nonprofit volunteer, and a hope-to-be- entrepreneur.  These things are also true.
I am slightly over halfway through a ten year sentence.  While I do think my sentence is too long, I don't think it's crazy or unreasonable. An important consideration in my sentencing was the danger to innocent bystanders I carried with me into each of those banks.
Let me pause a moment to say that I am actually sorry for the things I did.  Some of my victims were very frightened during my crimes, and I hate that I steeled myself to look at their fear without compassion.  I am sorry.
There are others less fortunate than I.  As I said, my sentence is neither crazy nor unreasonable.
I worked with a Ukrainian in my prison job.  I think he was innocent.  Not in a jail-is-full-of-innocent-guys way, but in a he-didn't-know-about-the-cocaine way.  In an actually and factually innocent way.  He was also inocent about how the US courts work, so he took his case to trial.  He has since been released back to Ukraine.  I wish him well, and I'm sorry my country stole a decade and a half from him.  Crazy and unreasonable.
I work with another friend whose sentence is crazy and unreasonable.  He is seeking executive clemency from the President.  You can learn his details at www.clemencyfortolu,com.  I can only imagine the personal animosity required to drive such a sentence.

It feels like I am taking too long to get to the point, so here it is.  When I am released in about four years, I will work hard never to break the law again.  If I were released tomorrow, I would work equally hard never to break the law again.  America is paying too much money to keep people locked up for too long.  We are often locked up long past the point that it stops serving any purpose.

 I think we as ppl community and society as a whole need to learn to crawl before

   we can learn to walk.
                      starting with our country and its laws along with the people whom govern our laws.
    First there are many of you who lobby for us inmates daily,actions in which we apprecitae and thank you for.
 But with that being said, there are many things the public and society needs to understand be fore it can make a firm stand.
The new good time bill that is being suggested by many is a positive and start to doing some good. but 1st things 1st
 there is a 15% good time bill thats already on the books.but is not being followed by law. we the incarcerrated community are to recieve 54days of good time a year but only recieve 47 of those 54days. i dont know why , but this is a fact.so you see before we can lobby for any additional good time, i believe the original good time % should be addressed. thank you for your time and ill keep intouch.

  handeling firearms daily. these employees are allowed to test fire and posses said firearms. felons whom have adnitted to stealing and reselling the companies firearms on the black market for a personal profit.To date none of these convicted felons"employees"  have been arrested or fired for their actions.but whom have been allowed to collect unemployment for
a brief period of time , until they have been redirected to a different branch of the company.
all under the watchful eyes of the atf. with out any arrests or sanctions for these violations. the most serious of which is the gun controll act.. look at the world and its violent events.Is this the actions that the public can allo to go un addressed?

To Whom it may concern
To add to your endeavors in getting signatures to bolster the parole/65% petition. I think it will be a great Idea to get a donation from inmates, to establish T-shirts that has the 65%/parole logo on it, for the support of such... And you can create a 65%/parole website as well, for the public... Its on thing to get families of incarcerated inmates,but, its another to get those as well, from the public, that do not have friends/family members incarcerated.. Now I know this cost money, but, its a get ass try to get the message out this way as well and inmates will see, how, serious this movement is... And you can get pictures of the shirts made and send a picture to those that donate so that they can see where there money went
