Make Fair Sentencing Act (FSA) retroactive                                                                                                                        My name is Emanuel Charles I’m currently incarcerated at the F.C.I. Oakdale facility and I believe that these particular laws needs some attention be cause of the draconian sentences that we are currently receiving as a direct result of these laws. I was convicted on June 21 2011 almost a year after the FSA was passed and I was still sentenced under the old 100 to 1 law that no longer was in effect. I was convicted of possession with the intent to distribute 180 grams of cocaine base and because i had a prior felony almost 20 years old I got an enhanced sentence of 20 years. 20 years for 180 grams of cocaine base or crack as it’s now being called this is an outrage.  I was working a full time job and I was supporting my 5 children I’m not trying to beat the system cause although the officers in this particular case broke the law to uphold the law I still wasn’t trying to fight the case for this reason alone because in the federal system even if you’re innocent the prosecutors believe the officers over you and it makes it hard to win your case when the cards are already stacked against you. In my case because I didn’t want to become a snitch for the government and I had a prior conviction this was all used against me. Now I’m in a situation where I can no longer help my family because of my incarceration for the next almost 18 years I understand that everyone gets punished for breaking the law but this is pretty extreme I would understand almost anyone position with 5 children to feed to get side jobs or try something that doesn’t effect the community I’m in no way saying selling drugs is the way to go but it could have been worse like robbing, stealing ,or even killing but the people that do these horrible things get lesser time than people get for selling drugs. I understand that mistakes will be made a couple of times in a life time but that’s why we’re suppose to be the land of the free. Although we make bad decisions some times doesn’t mean we’re not entitled to a second chance because since I’ve been here I’ ve met a lot of great guys who are just victims of there circumstances someone needs to understand we need help and giving us 20 years for a petty drug crime is not the way to help us. If given a second chance drugs will never be apart of my life again and I’m sure anyone going through a similar situation would feel the same I express great remorse for all the wrong I ever did in my life but I don’t feel that I ever did anything that would cost me the next 20 years of my life.Hopefully my situation could help someone else’s thanks for listening.

 1.My name is Isadore Gartrell #0347300 Iam in prison for Conspiracy to commit murder one with no conspirators and murder one. Iam currently fighting this case but the Clinton bill has really left me in the place we know as prison with out the fair
shake of the Federal law. It takes two or more people to conspire based on federal law and Iam sitting here with a conspiracy to commit murder with no one to have conspired with.  I think that these laws need to be look in to with a cats lens so that everything envolving a case can and shall be closely observed so that there is no miscarriage of justice like in the case United States V. Isadore Gartrell.  Having an illegal sentence, stemming from an illegal vertic of conspiracy which if taken away removes  the alleged malice and afore thought to commit murder in the first degree.
This Anti terrorism and death act has really caused alot of over crowding along with the many immigrants that are now being held over here in these prisons. There is no new laws passed for violent crime offenders and these prison cases need better evaluation, most of the time, prisoners are just trying to get out of jail, so there for they are willing to say anything to get released or get relief from prison by any means necessary.
We need some one to take justice serious and make it their sincere hobby and job to assure that justice stands while biasness and miscarriages of justice is condemned.
There is nothing being done for the inmates that have been accused of violent crimes in reference to a second chance and every case is different and there are some people who have really changed and turned there lives around in the real sense of the word an yet nothing is viewed nor look at the facts for whatever reason that shall bring fairness and justice for the oppressed. This case was a case that allegedly accured in Lorton Reformity, a place that was so very corrupt and mismanaged by both staff and administration a like, many men such as myself, lives are tore to pieces do to this well known an yet ignored fact. But no one cares out side of the many families that have to face the stress etc, that comes with having love ones that are victims of a once upon a time corrupt institution name Lorton.
The history of such a prison should have bee taken into consideration when it came down an investigation, how can you have such a short investiagtion upon a serious matter as murder one and think that you are able to achieve the factual results that will lead to justice.  The some of the lawyers envolving some of those cases had only taken a fundamental appraoche to sincerely helping those whom stand accused of various crimes in that very time of need which also have lead to the very same miscarriages of justice.
The Federal parole should be brought back and it should be made retroactive as well to assure that those of us whom have sincerely changed for the better may have a chance to live as a normal citizen and not as a prisoner.
The constitutionality of a case should be highly considered regardless of the time period envolving the Clinton Bill.
Again the Federal Law States that it takes two or more to conspire, so how do I remain in prison with a conspiracy to commit
murder with no co-conspirators?
We really need a voice out there, and we need
ears that will really listen and then act on our behalf.

1.Prison is an unfortunate and trying experience for anyone who has to endure it. But often times we are here, because of the choices we made. Now we can either learn and grow from the experience, or we don’t. There’s no in Between. Statisticaaly speaking about 67% of people leaving prison will return within 3 years. Now whether you fit into the 67 or 33% is totally up to you.

I was apart of the 67% time and time again. my goal now is aiming for the 33%. The one’s who never return. For most people when they enter prison their objective is to make their time as easy as possible, instead of as productive as possible. as an individual you know what your weaknesses are, be it drugs, lack of education, no job skills, no people skills or whatever.
This is the area you should be focused on. Strengthening your weaknesses so that you are able to make better choices.
They say ” A man will find himself, where he can best find himself” maybe it took prison for you to take a look at your life and the where it was headed and where you want to go. When we are in the midst of our “doings” we are blinded by the glitter of “The Game” that we don’t reach our full potential.

So if you want to be apart of the 33% of the people who never return to prison. You should spend this time productively.
make it a learning experience instead of a stagnant experience. Muhammad Ali once said “A man who thinks at 50 the same way he did at 20 has wasted 30 years of his life.”

1.I am currently incarcerated at FCI Miami.  I’m serving 235 months for crack cocaine.  I did not receive any time off my sentence for the 706 or 750 retroactive crack cocaine amendment.  The average crack cocaine offender is classified as a career offender, therefore cannot receive any reduction in sentence.  When Congress reduced the 100 to 1 ratio to 18 to 1, I was completely crushed, as were many.  There is ABSOLUTELY NO JUSTIFIABLE REASON FOR ANY DISPARITY.  If this law mostly effected WHITE PEOPLE, the disparity would have been completely ELIMATATED 15 years ago.  It’s laws like the crack cocaine law (even at 18 to 1) that African-Americans simply don’t have any confidence in the criminal justice system.  I do not have any respect for the system.  Because federal sentencing rules are excessively severe, and are deeply driven with racial disparities.  It is very wrong to change a law, make it retroactive, and then restrict the relief to only a selective few.  I am still serving a sentence based on the 100 to 1 ratio.  If Congress is so concerned about relieving the overcrowding, simply eliminate the crack/powder disparity and bring back good time credits (65%).

1.This letter is to inform the tax paying public that the sentencing, ranges and charges that send individuals to FBOP need, and must be changed in order to curb the cost to them. For instance, I have a felon in possession of firearm charge, which was normally a state charge. The “feds” have taken this type of charge and superseded the states’ sovereignty and this is a cause for the over-crowding, and the over-charging. Just my take, if you want to start making the federal government responsible and thrift minded, then get them to stop locking up half the country for frivolous charges. Start sending the illegal immigrants back without keeping them for several years, taxing the already floundering economy, and your pockets!!! Shan X.

1. My name is Kerry D. Laury. Ar the age 22yrs., old, a father of two children. I became a first time offender serving a unjust sentence of 89yrs. On November 1, 1992 in Dallas, Tx defendant and two other co-conspirators aided and abetted by each other affect commerce and attempted to do so by robberry with a gun. Staerted out as a state case but drop and allowed the feds to pick up to give more length sentences. upon Kerry d. Laury, plea of not guilty and testimony of two co-conspirator’s linking him as organizer and driver of these crimes only. Laury was found guilty by jury of aiding and abetting only. On January 12, 2005, the Supreme Court handed-down U.S. v. Booker, the federal guidelines for past 17yrs., does violate the sixth amendment. The court must dismantle the practice of ballooning a defendants maximum penalty, based on facts extracted after trial from a report complied by probation officere. Laury sentence of 89yrs., serving is unconstitutional result in sentences guidelines which been held unconstitutional.The judge sited t sentence: This mandatory minimum sentence is unjust. It far exceeds the proper sentence which this court would have imposed absent these congressional mandates. The Court therefore sentence the defendant at the lowesr possible point of the guideline range9although this afford little solace to the 23 yr.old defendant, since it merely means that he will recieve 89 years and 4 months). The Court cites this case as a clear example of outrageous punishment caused solely by mandatory minimum sentences. Quoted by Chief judge Jerry Buchmeyer October 22, 1993 in North Dstrict of Dallas Texas. “The catch” In 1996 Congress pas Antiterroism Effective Death Penalty Act bill limiting all federal prisoner one year to file relief for after direcy appeal. Saying that once your case become final you will not be able to file back in court unless new rule of constitutiona law made retroactive to acses on collateral review by Supreme Court that was previous unavailable. End other words the court’s aren’t allowing Laury or any other federal prisoner to file under Booker which supreme Court didn’t say from the ruling retroactive appilcable for those sentence incorrect for those sentence incorrect in past. the U.S. Constitutional isn’t being applied to no individal case to correct the wrong before 1996. Regardlesss if the new ruling comes out to correct a illegal sentences you may be serving. I’m a lost voice dieing in distress!

1.Inmates Denied Email Access
My facility, FCC Coleman Low, was one of the first facilities to have email access through Corrlinks installed for inmates. I believe it was installed around 2005-2006. Email access was to be unrestricted, meaning all inmates would have access. In practice this did not happen. Inmates with sex offenses were systematically denied email access for over 4 years. There was no official restriction on this category of offenders regarding email. The discrimination against this group was systemic at all levels of staff at this facility. By going through the inmate grievance process to the highest levels, individuals were able to have this unofficial restriction overturned and gained access to the email system.

In 2010 an official memo was issued. This memo stated that there were no grounds for blanket denial of email access to sex offenders and that all cases would be reviewed for email approval. Only inmates with email related offenses would be denied access. Still, some stalwart staff members are refusing to allow some inmates access to the email system. Because of how the approval process is structured, going from the unit counselor to the case manager to the unit manager, inmates entitled to email access are being stonewalled. Grievances are being ignored and the maximum time frame for responses being utilized by these staff members to continue to restrict access to some inmates.

This is happening on an individual basis. In my unit there was no issue. Reviews were conducted within two weeks of the memo and access was granted within days. However, in the B-4 unit, which is no different than any other unit, the entire unit team and the unit manager are refusing to review cases or grant access. They is also avoiding putting anything into writing regarding this issue. It is very unprofessional behavior on the part of the staff members responsible. Individuals are being unjustly denied access to the privileges enjoyed by nearly everyone else at the facility. I would urge anyone who is concerned about this to write to the regional office in charge of FCC Coleman Low and specifically mention the B-4 unit team and unit manager.

To Whom it may concern,
As I sit and ponder the last 20 and a half years I have been incarcerated,I am still amazed at a government that can continue to wage a war administeringsuch draconian sentences at its own citizens.
In 1991 I was convicted of a dry conspiracy,all my alleged co-defendants were convicted in an earlier trial in 1989.Two years later in an attempt to get their sentences lowered or gain release they learned that they could testfy against me to achieve this goal.Which apparently our government does on a regular basis.Let me make it clear that there is no real defense against testimony that can be made up or manufactered,as I learned the hard way at trial.Indeed,my case is not unique when it comes conspiracy cases.
The sad fact remains that this is a very broken judicial system that continues to incarcerate non-violeent offenders for 10,20 or in my case 30 years.
I have two daughters who were 4 and 9 when I was incarcerated,they r now 25 and 29.I have been more fortunate than most,my daughters have steadfastly stood my side all these long years and it takes its toll on everyone.the question remains,is how punishment is enough?
We have 120 federal prisons at a cost of approximately 6.5 billion dollars spent on the backs of taxpayers.We have an aging population whose medical expenses are skyrocketing exponentially.A logical solution must be addressed to bring an end to the warehousing of human beings.
States across our nation are solving their overcrowding prison problems.Our federal system must follow in their path.I have witnesses many organizations come and go with different agendas.I have never seen the support we really need to affect a change.If people can topple governments with the internet,we also must utilize this tool with one common goal,to reduce the prison population in the federal system,not build more prisons with a weak economy.We have 220,000 people incarcerated,we should be able to generate at least a million supporters or more.

To whom it may concern,
1.My name is Silas R. Swift, I am first time offender. I went to trial and was found guilty on “conspiracy to distribute a controlled substance” in 2009. I can sit up and write pages and pages giving you reasons why I feel like I don’t deserve to be incarcerated. I went to trial under the impression “I was not guilty” then the next thing I know I am in prison with a 15 year sentence over my head, all because some people wanted to get immunity , or get out of some minor trouble they were in, testified against me. We are all only human everyone makes mistakes in life, but why is it only a select few get second chances. I do not understand how a person be found guilty over hearsay from testimony of others who are already in the system and pretty much just want to go home from prison. That does not sound right to me, especially in a conspiracy and your one of the last to go to court. Everything is already planned out at least i have noticed the last person gets the most time innocent or guilty. I was found guilty because of false testimony and because I chose not to cooperate with the Government. How could I testify on things I knew nothing about. If I knew I could just lie in court like everyone else and get away with it, I would have given false testimony also and put someone else in my  place and be home with my family but Im better than that.Then i noticed  a lie wouldnt make you less of a person, not being there for your kids does. I am from Newport-Batesville  area in Arkansas. I have a 6 year old daughter named Heijah M. Swift (Asia) who I’ll do anything for, I want to give her the world and everything in it. I am locked up with people who have done major time. I missed one birthday of my daughters life and that was the worse feeling. So just imagine how they feel? When your use to being there everyday for your child and now you can barely talk to your child on the phone. I try to call once every 2 weeks to avoid the questions but they keep coming out of nowhere, “daddy why do you stay gone so long?”, “what did you do to get in jail?”, “why didn’t you come home for Christmas you missed everything?” real painful questions. And it is bad when a child hears something about money. My daughter wants to tell everyone she is saving all her money to get her father out of jail. It does matter where she is, school, stores, restaurants, or even church she is proud of her daddy. So, I know I was doing something right in her life. I now have one question I can’t answer. What could I say to my 6 year old daughter to let her know her father will always love her but will never see her until she is 21 years old, some of the punishments are to harsh. Some of honestly need a second chance, so what can we do about this? The one shot bill sounds good but what can we do to help pass it and put a stop to all the rumors because some of us really need to home with our families or just want to just start a new life already.

1.”FORMER ARMY SOLDIER, FORMER SAVANNAH POLICE OFFICER, NOW FEDERAL INMATE SENTENCED TO LIFE”…………….
                               You may be asking what did I do to be sentenced to life in the feds……. Well, I didnt kill anyone!! I was a 1st time non-violent offender who decided on a jury trial instead of a plea deal…… After serving nearly 7yrs. In the US Army, I came home to become a city Police officer… After 3yrs. i resigned to drive city bus for 1-year but I returned back to police dept. because I missed the excitement… The Dept. was contructing a reverse sting operation in which they allowed  a Former convicted drug felon who served 3yrs. in federal prison, become a paid  informant who would offer so-called corrupt cops the opportunity to assist him by becoming a escort and following behind him in a seperate vehicle while he was supposely transporting drugs… This would assure the informant that in case some undercover cop was to pull him over while he was transporting his drugs, then the hired officers he hired to be his escort would intervene and let them know they got this…All along this would be a setup on the officers who take the bait to become escorts for the informant… When the informant couldn’t get these officers they were after to follow all the way through with the entraptment scheme, The informant ran into me after i came back to the police dept. and he very craftily disquised a plan to get me to believe he wanted to hire me for a new club he was opening as his head security when I’m off duty… When i got to his apt. to discuss details, that’s when he offered to pay me whatever i want if I’d become his escort !! he said I’ll never have to see nor touch the drugs!! Ofcourse the feds never put any drugs in his hands but to make a long story short , Myself and 11-other Black male officers fell to this scheme and was arrested Sept. 10 th 1997 in Savannah georgia… 5 of us went to trial ..6–took a plea deal and 1–was aquitted…. Myself and 1-other Got life plus a 300moth sentence they inhanced us to .. When you go to trial, the feds can punish you more harsh… Anyway, I released a book called ” A Thug Cop’s Redemption” and it was released on  www.xulonpress.com…….. It’s a great tool warning our youth, adults, professionals or whomever wanna know the truth from this former Thug cop….. Yes i could’ve arrested the guy when he offered me this deal and I admit I should be punish for falling to that temptation especially when he said “I grew up with you and trust you and I’ll pay you what you want.” A Life Sentence as a 1st Time Nonviolent offender was too harsh and it shows just how bad our legal justice system is… Peace God Bless.. Dear Friends:
1.I want to talk to you about somethign that has not recently been talked about: Prison. Prison is a warehouse of tlents and skills that has not been touched to the point of assisting in developing the community; i.e. developing a new and better community for the children, the elderly and the hardworking person.  Listen, the wheels of life depends on the experience that a person has in a specific field, e.g. plumber, auto mechanic, carpenter, president, counselor, lawyer, etc.  What i mean is this, if you want to fix your plumbing, you call a plumber, if you want to fix your car, you call your auto mechanic, etc. right?  So if you want to fix your community, you need to dal with people who have experience in the wrongs with an attitude towards the solutions.  We, the prisoners know the problems, we also know the solutions, All someone has to do is ask.  No, not every prisoner is willing to help, but there are some, and a program to communicate those ideas is a thing needed.  Will talk you some more on this subject.

Life In The Game
June 8th 2004, was a day filled with sadness because I learned that a good friend ” Asmar Willie Benson’ had been murdered.  Just a few short years ago, he was here in Fairton F.C.I. walking ,laughing , eating and talking shit, together.
He was truly a friend and I hurt as his name is added to my’ Ghetto Fame’ poem.  I struggle with his death as I struggle with the many lives that are lost in our struggle to escape the grinding povery which envelops our communities. I wrote a poem which I titled ‘Ghetto Fame’.  I have Began this poem with names of some of my comrades and some of the people who have succumbed to the downside of the game. I called this my ‘Ghetto Fame’ poem but to imply that all the players in the game are seeking ghetto fame, would be an over-simplification of the game. I believe that most of the players in the game aren’t seeking any fame at all.  In my personal experience , I’ve had countless relationships with all kinds of hustlers.  For the most part, we are people, human people who desire to feed ourselves and our families, and enjoy some of the events and material  trappings that are offered in this life.  To be impoverished, and to suffer the effects of that poverty will drive a person to all kinds of suicidal schemes to raise their standard of living above the level which doesn’t allow a person to adequately take care of themselves or their families.

The list of people lost in the game can already fill volumes  and the beat will go on.  It is a beat or a rhythm which pulsates in the downtrodden’s being.  It tells us to make the sacrifice for the kids, for Grandpa & Grandma, and for all of those who will never understand the magnitude of your sacrifices. We’ve sold our soul…. and the game  has taken it’s toll! But, survival was our main goal! Yes, we’re forced into those survival of the fittest relationships within our communities.  And for some of us, our conscience struggles with all of the suffering produced by our lifestyles.

For many hustlers, there is no compunction felt, nor any connection made to those little girls and boys who suffer daily from hunger pains and are always ill-clothed.  These forgotten souls are littered throughout our wealthy nation.  There is no connection made to the countless young ladies who march up and down the ‘ ho strolls of America, displaying and advertising their precious bodies, to be violated by strangers or anyone willing to pay her price and willing to play Russian roulette with their own lives.

Many of my fellow hustlers never acknowledge the connection of our trade to the countless bodies which are paralyzed with pain and strewn on the streets of America.  We murder and brutalize each other in our efforts to survive the harsh realities of our lives in America.  I believe that ‘ Charles Dickens’ coined the  phrase in his [ Tale Of 2 Cities]: It was the best of times, it was the worst of times.” This is the tale which is the tale of the America, which I see.  I see those who thrive economically, and I see my brothers and sisters who struggle and suffer the effects of substandard schools and policies which only directs us to hopelessness. 1.My name is Deon Lorenzo Lyons,#30765- 048, 46 year old inmate at Federal Medical center Devens, P.O box 879 Ayer Ma,01432. I was born and raised in Las Vegas, Nevada.. I have been locked up 16 year, i was indicted for 30 gram of cocaine base in 1995.I went to trail on a superseded indictment with 17 counts and got convicted of 16 out of 17 counts and was sentenced to a unconstitutional sentence of 360 months(30 years) of imprisonment….

At sentencing the U.S. Attorney put 8.5 kilos of cocaine base in my sentencing with still only 30 grams of cocaine base of evidence…. Florence neglected to teat my high blood pressure in 19996, i got sick for untreated blood pressure in 19999.

the medical staff said i had renal failure and i need dialysis…. i transferred again in June 2000 to Springfield ,Missouri.. I begin dialysis for the next 7 1/2 years.. In 2006 i was transferred to Devens medical Center still on dialysis..in 2008 i received i kidney transplant… Now I’m all the on the  northeast far away from my family and friends…

I have lost my mother(Flora Mae Whitehead)in 1999 and the feds didn’t even let me bury her..Her only son.I also lost my grandfather and other family…I have not had a visit from my family or friends in 15years… i have a son that was 12 years old when i went to the feds….Now he is about to be 28 with his own family now..I can not see my granddaughter Chani.I think I’m experiencing slavery un the 21st century..

Key points, my possession was lawful in my state, state agents sought federal prosecution for my lawful possession creating an entrapment issue. the fed’s admit I do not meet their criteria for federal prosecution. And my twenty year sentence is based on convictions that all my civil rights have been fully restored for.

Murder didn’t faze me- thought myself too clever, Bullets wern’t going to graze me. I had some of the bloodiest blocks under my control- Now, I’ve got 17 years, and I am getting quite old.

You, my brothers, I know are running straight to the game- There’s nothing scaring you from your Ghetto Fame. I Like you, were hard to tame until the  feds and D.E. A. came to put an end to my Ghetto Fame.
George Orwell, in his book ‘ 1984′ talked about how our surveillance would soar -How the thought police would be on the prowl- and most of that shit is happening now.

Ghetto Famer, you’re playing with the same fat-ass chick whose played with many a trick. She’s telling you, ‘ Daddy you’re the greatest’ although you’re only the latest to be drawn into her slippery- web.                                                                                                                                                                                                                                                             I  I don’t want to imply that all women are the same- Some care less about your Ghetto fame.                                                  
Remember that a little of the story was told when the chick goes from hot to cold- because your bankroll has begun to fold.

I had it, could’ve lived any place in the world-now, I am in prison, broke and don’t even have a girl.

I know tha you call it survival or some other name- For lack of a better phrase, I’ll call it Ghetto Fame.

I know that your sense of belonging has a firm grip- So you become Latin King, Blood and Crip- Which is a part of the same Ghetto trip.

You will for the color Blue or red, shoot your brother and sister dead- What the fuck has  has gotten in your head? – I am talking to you to Dread!

In the cage we get our  props- most call our name while we ride the remnants  of our Ghetto fame, but a lot of us won’t be going home again.

Ridiculous sentences, Constant Jerking, Brothers Berserking, Yes, plenty of jailhouse strife while all day holding on to your knife. 

I just want you to get a glimpse off the other side- So you can realize that it’s not an easy ride.

   The woman who wrote about defendants “opting out” for trial is right, more people ought to opt out for trials and “crash the system”. This is why they dropped so many charges in California and New Orleans, the system could not handle mass defendants. It teaches the system and the prosecutors that they have not been exercising their “discretion” by prosecuting so many people.
   Furthermore, we need to send a message to our legislators that crime should not be “Big Business”, like it has now turned into. Legislators should stop criminalizing every little thing, such as crimes without “mens reas”, that citizens do not even know they are committing. Our Forefathers did not criminalize so many things when they drafted and implemented our Constitution, and are spinning in their graves right about now, in all the different interpretations of the constitution. Big business’s's are making billions off our imprisoned brothers and sisters, from Access catalogs, to toilet “doughnuts” made by criminal corrections companies to stop cell flooding, the cottage industry that sprang from the Prison Industrial Complex is staggering.
   It will take some sacrifice to get this point across, but the flooding of our jails right now, has not yet woke our legislators and judiciary up. Maybe flooding the Courts with mass trials will.

” Stormy Weather Of The Hood”
    An Open Letter by;  Reginal  V. Shareef

             There was Tsunami, then Katrina, and now an earthquake in Pakistan.  Hundreds of thousands dead and the death tolls continue to rise.  My deepsest sympathy goes out to all of those humans and their families.  Yes!, all of those natural catastrophes are heart-wrenching and we can not help but to be passionate in our desire to help.  But there is a storm which has destroyed and crippled millions in our hoods across America, and we shouldn’t be dispassionate about the sufferings and pain of these people because the media doesn’t think it good copy.

           It is the storm of indifference to our at risk youth. It is the storm of Racism and Classism.  It is the storm of substandard schools in my Afican American community, and communities throughout this great nation.  It is the storms of bondage which flourishes in it’s various forms.  It is the storm of myths which started long ago and still tells our sons and daughters that they don’t have the intellectual capabiltities as other children. It is the storm of wrong choices which we help our children make by giving them messages e.g. ( get rich, or die trying!).

          These many storms of destruction and disaster have claimed millions of lives in this country by blowing and washing those precious lives into the graveyards and into the prisons with sentences which often exceed their life expectancies.  My sister was murdered as a result of the storm.  four (4) of my son’s have been to prison as a result of the storm. My Beloved Daughter Rasy is in Clinton State prison,My daughters , Teisha and Najimah have been victims of this storm which continues to ravage so many lives in our impoverished communities.. One of my sons was just recently shot as a result of the storm. And a very good friend ( Akbar Pray) loss 5 of his children to this vicious storm.


           The storm of the game has buried me for (206) months in this cage . And I always try to quell the storm which has taken root in so many other lives . Because I am the real article who truly lived by the principle of ( Get Rich or die trying).
When I lived that life I cared  nothing about dying, I had no idea that the  death which I thought about often could be exacted a little at a time, while leaving me half alive in this void. Yes, every time I hear of the senseless brutality and the other nonsense which is happening to my brothers and sisters in the struggle, it seems as if my breath is excised from my body and I brought closer to death.

         I am going to end this short  letter here and hopfully, my pain will penetrate some ones thinking and guide them from “The Stormy Weather In Their Hood”.

Peace!, As-Salaamu Alaikum!, Hey!, Que Pasa!, What’s Happening?!
        It’s me again trying to reach from within to bring you some thoughts which will strimultste your thinking and possibly guied you along with myself to action, and, to a better understanding of this intricate life which we live. 

          I’ve been reflecting on the saying ” THE MORE THINGS CHANGE, THE MORE THEY STAY THE SAME”. I on’t try to attribute this saying to any one indiveidual or coulture, because many cultures claim amny things and I am not in a postition to make an absolute determination about who is the rightful owner of particular writings or phrases. However, my late aunt Alice Gertrude Townsend, swore that a very distant relative or ours coined that saying, and many othrs which were attributed to Aesop, and other great men of antquity.  My aunt was a number banker and number player, so she thought she had a great deal figured out.

         The oral history of my family was not a rich one by any stretch of the imagination, but I do remember vividly (2) stories as told by my father who was never a member of my household, but we did have some contact,  because one of my Special grandmothers ( Dorthy Holme’s) would babysit me often.  The first story which my father shared was aaobut my great grandfather or grandfather who was said to have pulled money out of the air during the great depression.  There was also the story of the Black witch who never ever appeared while her cat roamed the deepest  recesses of her tree lined yard.  My father told me that one day him and a friend struck the cat on the head over the right eye, and later that day, they saw the witch and she had a large knot over her eye in the smae exact place as where they had hit the cat.

         I must now get to my intended topic because I’ve already wasted valuable space, and valuable units which both may be needed for something more valuable to discuss.  Hopefully I can keep my thoughts short and  clear.  My topic, as previously mentioned, is centered around the words, ” THE MORE THINS CHANGE, THE MORE THEY STAY THE SAME “. Here, I will attempt to talk about our human family, and aobut some of the things which I see from the Ante-bellum south, which seem 
to stay with us despite many dramatic changes in this America{ Sweet Land Of Liberty}.

        The use of slaves in the history of man speaks of amny different systems of bondage, but the use of slaves in the Ante-Bellum south was a deliberate choice among other  alternatives.  I look at the enormous percentage of African Americans and Hispanics who fill this prison along side of me. Then I think of the large segment of criminals of white america who are not adequately represented in the cages of America’s new plantations.  I again wonder if the current situation of disproportionate numbers of African Americans is not a deliberate choice.

       The cornerstone of slavery in America was African American labor, and today the cornerstone of one of America’s most prolific industries in the African Amercan male and female.  “THE MORE THINGS CHANGE, THE MORE THEY STAY THE SAME”.

        I begin here with a few lines from Professor Kenneth M. Stampp’s book( The Peculiar Institution).”   Nowhere regardless of constituional or statutory requirements, was the trial of a bondsman apt to be like the trial of the freeman.  Though counsel was guaranteed, though jurors might  be challengedm though Negroes xould testify in cases invlolving members of their ow race, the trial of a slave was never the trial of a man by his peers”.Sure, some today squeeze through the very small cracks left open in some cases. But fro most, you’re guilty until proven innocent. And corrupt and  ambitious prosecutors and police will not bar too many strategies in their efforts to convict you, and to further their own  careers.  ” THE MORE THINGS CHANGE, THE MORE THEY STAY THE SAME” .

          In the year 1829, David Walker wrote a very passionate document called, “Walkers’s Appeal”. The document said an awful lot aobut the state of America at the time, but I’ll only borrow a few lines from the work  so that I can bring these pages to an end. He said, ” See the African repository and Colonial Journal, from its commencemnt to the present day. See how we are through the medium of that perodical, abused and held up by the American’s , as the greatest nuisance to society, and throat cutter’s in the world”.  In today’s periodicals(e.g.) newspapers, television news, talk radio, and countless other venues, African Americans are portrayed negatively and held up as societies greatest nuisance.  ” THE MORE THINGS CHANGE, THE MORE THEY STAY THE SAME”.

          In the Ante-Bellum south when many African American’s were considered property, it was not uncommon for the slave master to bequeath to his family his slaves, the children of his slaves, and even the children of those children.  Although, there is no legal documents to bind us to any outlandish contracts, we as a people have allowed ourselves to be chained to those contracts.  I am not particularly talking about the handcuffs or  the leg-irons which many of us know so very well. The chains which come to my mind, and which I find the most cumbersome, are the chains of ignorance and oppression, which keeps our communities steeped with hopelessness. “THE MORE THINGS CHANGE, THE MORE THEY STAY THE SAME.”

          I am gong to close  here with a passage from Frederrick Douglass, who is one of our greatest symblols of liberation. He wrote in the Newspaper: THE LIBERATOR, on May 26,1865, ” It has been called a great many names,and it will call itself by yet another name; and you and I, and all of us, had better wait and see what new form this monster will assume, in what new skin this old snake will come forth.”  ” THE MORE THINGS CHANGE, THE MORE THEY STAY THE SAME!

1.This is the first of what will most likely be many entries for me. I have a lot to say on the subject of who we are in here and how it is that we survive. I have been doing time since I was 9 years old. At that age I ran away from home, ended up so far away that my feet hurt from walking and I stole a bike to get back. I was picked up and arrested fro run away and theft. You would think that I would receive a slap on the hand and sent back home. Instead I was placed in juvie hall for 10 months. At that age I did everything I could just to keep from getting beat up. Unfortunately I learned to well and ended up doing okay. After that, because I had already been to juvie, every time I did anything wrong I went straight back. I was placed on probation and every offense no matter how trivial brought me right back to jail. Now here I am at 39 years old on the last year of a seven year stretch. I have spent most of my life in prison and do not really know any different. I have been married since 1999 and I have two beautiful daughters that I do not really know at all. I have spent more time with them on the phone than anywhere else. So why am I saying all this? Just this; I wonder where the justice in our system is when a 9 year old boy who steals a bike has his the rest of his life set in motion because our justice system does not know what else to do with him. I know this sounds like a sob story but believe it is not. This is merely an intro into the life of what our system calls a “career criminal”. I want everyone to understand who most of us in here really are. Even the harder ones.

                 I use to be the happy vibrant man of the house-Now I am living in this cold hole like a lowly mouse.
Snarling caged animals all around, while others stroll making not a single sound.
My sturdy virility jumps around each and everyday, while I try to keep this feelings at bay, because I have no one which              to lay,
The morning is again ignited with a glowing  morning sun, and again my life struggles are weighing a ton.
 Everyday is a breakdown for me, because although my spirit soars, my body can’t be free.
Old man winter is again approaching with his may chills, and those green mountains will cease to toss her amazing
                thrills.
Again I am immobilized and transported back to te place you take me to year after year,
 A place with those colors which I truly hold dear, a place where my heart and eyes sometimes tear.

                   The pedals on those gigantic windmills slowly churn, while my desire to be free deeply burns.
Burgundy,Brown, yellow, orange, and the different shades of green, are preceded by the impending barren scene, or swirling leaves, and empty brown trees,
Which cares nothing of my countless pleas which I dispense humbly from these aching knees,
 I cry out ,Please! Please!, go back to your trees, give me more beauty before the approaching freeze,
 Please! Please!, for one more moment allow your Extravagance to be seized.

 We often read, see on the news, or hear others in conversation discussing injustice, inhumane sentences being imposed for crimes outside American soil.  But what our sources who are feeding that information have failed to inform you about are the injustices toward blacks, Latinos, and many others that don’t have a certain amount of wealth in this country.  It would quickly give those outside prison the impression that blacks are natural born criminals because they represent a large number of the 218,000 inmates in the federal prison system– largely given long Draconian sentences for petty crimes.  The majority are young-  in their 20s, and many never got a chance to venture outside their home state; never mingled with others from far and beyond.  Perhaps getting a chance to meet and greet others could have resulted in interactions with a positive role model.  Perhaps these young men and women might have taken a different road.  The so called ‘war on drugs’ has turned into a war on African Americans.  The laws have destroyed families in the African American community and caused many of our families to lose their hard earned possessions, inherited through generation after generation.
  We must ask our lawmakers in Congress what was on their mind to allow such inhumane treatment against people of color, and go on to call on the lawmakers to create a truly fair sentencing act.  I was a young man when I entered prison in May, 1988, being 36 years of age.  Now, at 60, I have been federally imprisoned for more than two decades on trumped up charges of conspiracy with intent to distribute 50 grams or more of crack cocaine.  It is time to ask our lawmakers, where is the justice?
  The laws, especially drug laws, have been extremely devastating to black men and women of this country.  I want to present this statement to our lawmakers in Washington.  Did you know that the majority of people you place behind bars for long sentences are black, uneducated, poor, unable to defend themselves- much less hire an attorney to represent them in a court of law?  Many of these men and women are not the ‘kingpins’ you try to describe them to be.  All of you, as lawmakers, should be ashamed of yourselves for allowing this foolishness to go on, and not supporting changes that would allow the law to be applied equally among God’s people; not based on the color of one’s skin, or their financial condition, or their educational background.  Your lack of support is felt far beyond these barbed wire fences, topped with razor wire, or the high walls many of us sit behind as I write this letter of plea to you tonight.  Changes are greatly needed for all of us, that will allow us to be reunited with our families and loved ones.

I totally agree with Susan and I commend your for presenting this issue.  But one of the BIGGEST ISSUES…that contributes to the huge minority (Black) population and the mass incarceration of United States citizens, is the 13th Amendment of the Constitution.  The 13th Amendment has a ‘EXCEPT CLAUSE’ which says, “Slavery and indentured servitude shall be forever abolished, EXCEPT, when you have been duly convicted of a crime in the said United States….Its clear that once you’ve been convicted of a crime, YOU ARE A SLAVE…PERIOD.   Prisoners are the neo-slaves….how else can prison officials justify paying a man $5.25 per month to mow acres of grass in the hot blistering sun…$5.25 a month is truly a slave wage. 

I’ve found that most people are alarmed when I make them aware of this ‘except clause’.  I’ve also wondered if any politician, Judge or Justice have ever address this issue.  Maybe now is the time to bring this issue to light, In January 2012, filed a motion to the Supreme Court captioned…MOTION TO STRIKE THE EXCEPT CLAUSE FROM THE 13TH AMENDMENT.  To date I have not heard a word from them, not even a notice of acceptance of the motion.  More than likely, it will be lost in the sause and I will never hear from them.  I find it hard to believe that I am the only person aware of this ‘except clause’.  Hopefully, if you publish this letter, more people will began to press the issue….People with Rights…because SLAVES HAVE NO CONSTITUTIONAL RIGHTS !

Once again, I approach you with a Letter From the Inside.  I recently sent a letter to the Congress of the United States, and spoke to them about the Second Chance Re-Authorization Act of 2011 S. 1231.  Below is the sample letter:

Second Chance Re-authorization Act of 2011 – S. 1231 – Speaking on behalf of 800 Federal Prisoners from FCI Victorville, California.

We have read portions of S. 1231 that was introduced into the Senate by Sen. Patrick Leahy and Sen Rob Portman which offers two benefits, among others, to Federal Prisoners, to wit:

1. They could earn up to the full 54 days of goodtime per year; and,

2. They could earn an additional 60 days of goodtime per year for participating in ati-recidivist programming.

Regarding the Second Chance Re-authorization Act, we first want to thank you, as well as others who have offered their favorable support of S. 1231.

The Second Chance Re-authorization Act, we understand, is presently in the Senate waiting on a successful vote.  It is our hope, prayer and request that this bill be passed in the Senate, and passed on to the House of Representatives for their successful vote.  Yes, Congress, we will participate in any anti-recidivist programming that becomes available.

             Orange, Yellow, and red and green leaves floating gently to the ground-  Making what I assume is  their old
                     familiar sound.  A Crack! A Swish! A Swirl!, Oh how I miss you, ole Beautiful World.
                    I  watch the leaves still on the branch, as they perform their leaf dance.   They are rolling and holing fast, but  winter is coming, so how long will they last.
                    I sit and reflect on the tree of life, through  this barren cage feeling tints of anger, tints of rage.
                    Is this the ending, My Last page? Will my epitaph read: Reginal V. Shareef– Death in a cage?
                   I smile!, I cry!, I dance, and I too hold fast, But winter is coming, so how long will I last?
                  Not  many of us want to die, not even those leaves falling from the sky.

Letter to the public

1.As incarcerated brothers an sisters you will never here about the good things we have done during our incarceration (the program we have taken, the degrees we have received among other things) but what you will hear is how of a dog we are, how dangerous we are to the communities and the people in it..every time you turn on the Radia,Television or open a news paper we are among the open and close topics, we are the butt of every comedian jokes,  the cause of everything bad thing  that happen or will ever happen in society  (whether we ever have a chance to free or see the light of day again) and to be very honest  with you, we understand.  We also understand that when news papers and magazines need a boots in their rating  they call upon us to make that happen.  Most importantly, we understand that we can not stop the lawmakers from using  us to justify the their action for making stiffer laws….and to all my uneducated family. Especially, our sister, we do not hold it against you because you allow the media to fool you into believing  that as incarcerated brothers we are responsible for the high  H.I.V / Aids rates that is plaguing our communities “because coming to prison make us homosexuals” and we definitely do not blame you for believing the stigma that say “all incarcerated brother are con man  and all we want to do is con and trick you out of your material positions”.  That we can live with…We may even accept you calling us animal society rejects and any other names you choose to call us.  Because you do not know any better.
      But  please allow our families and love one to live a peaceful and productive life.  Through their suffer humiliation they have earn it. they have been through  a whole lot enough already, because of the action and choices we made.  You  all refuse to give us a second chance in live, you turn your back on us and we have no problem with that……But for those who choose to stand by us, suffer the shame loneliness with us by coming here weeks after weeks months after to visit us.  Who is struggling to keep a roof over their food on their table and make sure that our children does not fall victim to the system they deserve to be left alone…..Also we beg you all to allow our children to live their lives and not be punish for our choice. I understand that many of you may not be strong enough to stand by your people or you may not know or understand the meaning of loyalty….and we respect that….In life we have the choice to make our own choice and stand by the choices make…..good or bad….and we have respected the choices you made not be apart of our lives…..not allow us to come into your world…..so please I beg you…respect our family and love ones and the choices they made to stand by us….it  is their right…appreciate your understanding in this matter….Mr. Wing

03/19/2012 (Ulysses Thomas Ware) (Atlanta GA) Prison Camp

Motions to reopen and motion for appointment of a special prosecutor to investigate the fraud committed in US v. Ware (04-Cr-1224 (RWS)(SDNY) and (05-Cr-1115 (WHP)(SDNY) pending in SEC v. Small Cap Research, 03-0831-KJD-RJJ (D. NV).

Here at the Atlanta BOP Camp on March 13, 2012 at 9:00 AM corrections counselor L. Miniss illegally confiscated all Thomas Ware’s legal books, in violation of federal law (28 CFR 543.11(d)(1, 2)), and wrote up a false and fraudulent incident report to retaliate against Ware for filing motions in the courts (2d Cir court of Appeals) for bail, and to have the indictments dismissed in the 1224 and 1115 case — a clear violation of Ware’s First Amendment right to file grievances in the court in regard to his illegal sentences and convictions.

    The BOP and the courts are conspiring against Ware to keep him in prison when the case (1115) was dismissed on Nov. 7, 2008 by the Department of Justice’s Office of the Solicitor General, (the “OSG”); and 1224 was dismissed on May 18, 2011 by Judge Robert W. Sweet, cf. Dkt. #125 in 1224 at P. 2 para. #2 (there is the “absence of any case or controversy”).

I’ve been in prison for 18 years for arm bank robbery at the early age of 19.  I have given the best years of my life to the BOP and the system that has no understanding for compassion for human life or it’s mannerism of young men.  I’ve lost both parents and a older sibling within the pass 7 years and wasn’t allowed to attend the wake or funeral and the BOP wants to continue to punish me for conduct over 18 years ago to this date. Which means no camp or adjustment before released back to the world call society.  My reason for addressing this issue at this point is because help isn’t about helping yourself when you can’t help yourself by the conduct or activates within these walls.  They put MP3 player in a system; that need to teach us how to return back to the world.  I can’t express it enough that we are fighting a battle with the wrong minds at the wheel.  The people looking on the outside in and inside out haven’t changed what they think about prison and prisoners haven’t changed what they think about the system that hasn’t help them or their family’s.  The system has destroyed faith in justice because justice has know face or accountability for it’s action to help change.  It’s like right now the institution that I’m being held at has a different view of the Second Chance Act and they feel that if you have not done 20 years you shouldn’t request 12 months halfway house; Unless you costing them money because of your health.  The truth is if you as individual don’t step up to change your life, what’s out their for you; but prison for those how don’t believe in themselves.  We have to have something that will address the wrong in the system in every area or the battle for what is right will be egg on our face for not thinking everything out. I love the fact that you have given us a voices.  I just wish it was their along time ago. Thank you for your time.

I WAS TRIED SEPARTELY BECAUSE THE GOVERNMENT SOUGHT THE DEATH PENALTY AGAINST BOBBY AND MICHAEL FOR THIER ROLES IN THE TRIPLE HOMICIDE THAT TOOK PLACE IN FEBRUARY OF 1996, ALONG THE 1100 BLOCK OF SPERLNG DRIVE.  A RESIDENTIAL STREET IN WILINSBURG, PENNSYLVANIA.  THEY WERE TRIED ON A SUPERSEDING INDICTMENT THAT CHARGED FIFTEEN COUNTS.
THE JURY FOUND BOBBY AND MICHAEL GUILTY ON ALL COUNTS EXCEPT COUNTS THREE AND FOUR, BUT DETERMINED THAT THEY SHOULD NOT RECEIVE THE DEATH PENALTY. BOBBY AND MICHAEL WERE SENTENCED TO MANDATIRY LIFE IMPRISONMENT.
I WAS TRIED ON A SUPERSEDING INDICTMENT CHARGING FOURTEEN COUNTS THAT MATCHED BOBBY’S AND MICHAEL’S INDICTMENT THROUGH COUNTS THIRTEEN, OMITTED ONE OF THE FIRE ARMS COUNTS AND CHARGED THE MONEY LAUNDERING COUNT AS COUNT FOURTEEN INSTEAD OF FIFTEEN.
I PROCEEDED TO TRIAL IN THE SOUTHERN DISTRICT OF NEW YORK BEFORE THE HONORABLE NAOMI REICE BUCHWALD AND A JURY ON JUNE 21, 2005.  AT THE END OF THEIR DIRECT CASE, UPON THE GOVERMENT’S MOTION, THE DISTRICT COURT DISMISSED COUNTS FIVE, SIX, SEVEN, NINE, TEN, ELEVEN AND TWELVE.  THESE WERE ALL THE SUBSTANTIVE COUNTS THAT WERE RELATED TO THE PENNSYLVANIA TRIPLE HOMICIDE.
ON JULY 8, 2005 THE JURY FOUND ME GUILTY ON SIX OF THE REMAINING COUNTS SUBMITTED FOR THEIR CONSIDERATION.  I WAS FOUND NOT GUILTY ON COUNT FOUR WHICH CHARGED THE CONSPIRACY TO MURDER IN AID OF RACKETEERING (THE PENNSYLVANIA TRIPLE HOMICIDE).
ADDITIONALLY, THE JURY WAS HUNG WITH RESPECT TO RACKETEERING ACT 1 (b) (ATTEMPTED MURDER OF VICTOR MERCADO) ; RACKETEERING ACT 2 (a) ( CONSPIRACY TO MURDER BERNARD WILLIAMS) ; AND RACKETEERING ACT 2 (b)  (ATTEMPTED MURDER OF BERNARD WILLIAMS AND CARLOS BRYANT).
ON OCTOBER 7, 2005, I WAS SENTENCED TO CONCURRENT TERMS OF LIFE IMPRISONMENT ON COUNTS ONE (RICO), TWO (RICO CONSPIRACY) AND FIVE (NARCOTICS CONSPIRACY); CONCURENT TERMS OF TEN YEARS ON COUNTS THREE (CONSPIRACY TO MURDER VICTOR MERCADO) AND SEVEN (MONEY LAUNDERING); FIVE YEARS ON COUNT SIX (924(c)) TO RUN CONSECUTIVELY TO THE SENTENCE ON ALL OTHER COUNTS.
I WAS GIVEN A LIFE SENTENCED FOR “CONSPIRACY TO DISTRIBUTE AND POSSES WITH INTENT TO DISTRUBTE CRACK COCAINE AND COCAINE, 841 (b)(1)(a).  MY MANDATORY MINIMUM ON THIS CHARGE IS FROM 10 YEARS TO LIFE IMPRISONMENT AND EVERY OTHER CHARGE THAT I WAS CONVICTED ON  (INCLUDING THE 3 OVERACTS IN THE RICO COUNT)  ALL CARRY A MAXIMUM SENTENCED OF 10 YEARS IMPRISONMENT.  MY TOTAL CRIMINAL HISTORY POINTS IS “4″ ,MY CRIMINAL HISTORY CATEGORY IS “3″ AND MY OFFENSE LEVEL IS “43″, WHICH DO CALL FOR A LIFE SENTENCE.
MORESO, AS TO EACH OF THE COOPERATORS WHO TESTIFIED AT TRIAL, THE COURT HAS TO DETERMINED THE CREDIBILITY OF ALL OF THEM AND IT IS VERY CLEAR TO SEE THAT THERE WAS AT TIMES DISPARITIES IN THE QUANTITIES THAT WERE ALLEGED TO HAVE BEEN PURCHASED OR SUPPOSEDLY THAT HAVE BEEN DISTRIBUTED.  THE JURY OF COURSE, SIMPLY MADE A FINDING THAT AT SOME POINT THAT I WAS INVOVLED IN A CONSPIRACY TO DISTRIBUTE  “AT LEAST 50 GRAMS OF CRACK COCAINE AND AT LEAST 5 KILOGRAMS OF COCAINE.”
HOWEVER, THE JURY DID NOT TELL THE COURTS AND THEY CERTAINLY DID NOT TELL IT IN IT’S VERDICT WHETHER IT BELIEVED ONE OR ALL, OR EVEN HALF OF THE COOPERATORS IN REGARDS TO DRUG QUANTITY WHO CAME IN TO TESTIFY ON BEHALF OF THE GOVERNMENT.
AT SENTENCING, THE JUDGE STATED;  “THERE WAS AN ABUNANCE OF TESTIMONY FROM NUMEROUS WITNESSES IN ADDITION TO MR.FELICIANO TO SUPPORT A CONCLUSION THAT THE DEFENDANT DISTRIBUTED IN EXCESS OF 150 KILOGRAMS OF COCAINE.”
ADDITIONALLY, I ALREADY CLEARLY POINTED IT ALL OUT IN MY 2255 MOTION, THAT ALSO CONTAINED NEW EVIDENCE THAT COOPERATING WITNESS “RICHARD FELICIANO’S” TESTIMONY REGARDING QUANTITY IS NOT CREDIBLE.  THE RECORDS ALSO CLEARLY SHOWS THAT JASON PROTINICK AND VICTOR MERCADO’S TESTIMONY IS NOT CREDIBLE AT ALL REGARDING QUANTITY.
RICHARD FELICIANO WAS THE PROSECUTIONS MAIN DRUG COOPERATING WITNESS WHO TESTIFIED IN MY 2005 TRIAL ABOUT SELLING ME 500 KILOGRAMS OF COCAINE FROM 1994 UP UNTIL HIS OWN ARREST IN 1997 AND IN ANOTHER TRIAL OF JEFFREY FLORES IN 2001. FELICIANO TESTIFIED THAT HE SOLD ME, ALONG WITH ANOTHER MAN TOGETHER “APPROXIMATELY 20 KILOGRAMS.”
FURTHERMORE, ON DECEMBER 13, 2001 THE HONORABLE ROBERT W. SWEET FROM OUT OF THE UNITED STATES DISTRICT COURTS FOR THE SOUTHERN DISTRCT OF NEW YORK, STATED IN OPEN COURT AT FLORES’S SENTENCING:  “RICHARD FELICIANO AND IT’S ATTRIBUTION OF MANY HUNDREDS OF KILOGRAMS OF COCAINE TO FLORES IS NOT CREDIBLE IN IT’S ENTIRETY.”
FLORES WAS SENTENCED TO 151 MONTHS IMPRISONMENT, TO BE FOLLOWED BY 5 YEARS SUPERVISED RELEASE.
I WAS SENTENCED TO LIFE IMPRISONMENT FOR THE SAME EXACT DRUG CHARGE THAT FLORES WAS CONVICTED ON, FOLLOWED BY A LIFE TIME OF SUPERVISED RELEASE.
THE PROSECUTION ALSO ALLOWED RICHARD FELICIANO AND JASON PROTINICK  (TWO KNOWN PATHOLOGICAL LIERS)  TO GIVE FALSE TESTIMONY THAT WENT ON AS  “UNCORRECTED.”
THE JUDGE SENTENCED ME TO LIFE IN PRISON IN REGARDS TO THE WITNESSES FALSE TESTIMONY REGARDING QUANTITY AND IN NAPUE v.ILLINOIS, 360 us 264, 3 Led 2d 1217, 79 S.ct 1173  IT STATES:  “IT’S OF NO CONSEQUENCE THAT THE FALSEHOOD BORE UPON THE WITNESS CREDIBILITY RATHER THAN DIRECTLY UPON DEFENDANTS GUILT.  A LIE IS A LIE, NO MATTER WHAT IT’S SUBJECT, AND IF IT IS IN ANY WAY RELEVENT TO THE CASE, THE DISTRICT ATTORNEY HAS THE RESPONSIBILITY AND DUTY TO CORRECT WHAT HE KNOWS TO BE FALSE AND ELICIT THE TRUTH.
THE GOVERNMENT ALLOWED JASON PROTINICK TO TESTIFY  (AFTER MANY LETTERS TO THE DISTRICT JUDGE TO ALLOW HIS TESTIMONY TO HELP PROVE THEIR CASE.)  THAT IN THE MID-SUMMER OF 1996, PROTINICK DROVE TO MONROEVILLE, PENNSYLVANIA TO MEET UP WITH ME AND THAT I DEPOSITED  $110,000.00 INTO HIS CAR.  THEN HE TESTIFIED THAT HE MET BACK UP WITH ME TWO DAYS LATER IN THE BRONX, SO THAT I CAN PICK THE MONEY UP FROM HIM.  ON CROSS-EXAMINATION, DEFENSE COUNSEL ESTABLISHED THE CERTAINTY OF JASON PROTINICK’S MEMORY WITH RESPECT TO THE YEAR, SEASON AND TEMPERTURE.  HOWEVER, IT WAS ESTABLISHED THROUGH TESTIMONY AND CERTIFIED DOCUMENTS THAT I WAS INCARCERATED IN NEW YORK CITY JAIL AT THE TIME AND THAT IT WAS EXTREMELY IMPOSSIBLE FOR ME TO HAVE PARTICIPATED IN THIS MONEY- TRANSACTION ACTIVITY.
FURTHERMORE, THE GOVERNMENT ALSO ALLOWED JASON PRONICK TO TESTIFY THAT I WAS PRESENT WITH TWO OTHER MEN, WHEN THEY TOOK A SHOOT AT HIM SOMETIME SHORTLY AFTER SEPTEMBER 8, 1996.
THIS TESTIMONY WAS ALSO PROVEN TO BE UNTURE FOR THE SIMPLE FACT THAT I WAS INCARCERATED FROM MARCH 1, 1996 UNTIL APRIL 1997.
THE GOVERNMENT CLEARLY KNEW THAT I WAS INCARCERATED DURING THIS TIME PERIOD AND YET THEY STILL INSISTED ON PRESSING THE ISSUE ON ALLOWING JASON PROTINICK TO TESTIFY TO THESE FALSE ALLEGATIONS. I HAVE NEVER BEEN ON PAROLE, PROBATION OR ON ANY TYPE OF SUPERVISED RELEASE PROGRAM AND I HAVE NEVER EVEN BEEN SENTENCED TO SERVE ANY TYPE OF STATE OR FEDERAL TIME OF IMPRISONMENT.  MY CONVICTION ARREST RECORD CONSIST OF MINOR THIRD DEGREE, FORTH DEGREE AND FIFTH DEGREE CRIMINAL MISDEMEANOR CHARGES. THE MOST SERVERE SENTENCED I HAVE EVER SERVED FOR ONE OF THESE CHARGES WAS  “CONDITIONAL DISCHARGE AND 4 DAYS COMMUNITY SERVICE.”  THIS SENTENCED WAS GIVEN ON AUGUST 31, 1993.  BUT YET, AT SENTENCING, THE JUDGE STATED ON THE RECORD:  “THE RECORD HERE IS ONE OF A LIFE TIME OF CRIME, EACH NEW CRIME IS A NEW DECISION, AND AT NO TIME BEFORE HIS ARREST DID MR.WILLIAMS ABANDON HIS CRIMNIAL ACTIVITIES.”
ACORDING TO MY CRIMNINAL HISTORY, THIS COMMENT WAS ENTIRELY INAPPROPRIATE.
ONCE AGAIN, I WENT TO TRIAL AND WAS FOUND GUILTY OF AN 841 (b)(1)(a) DRUG CHARGE, WHICH WAS THE ONLY COUNT THAT I WAS CONVICTED ON THAT CARRIES A MANDATORY MINIMUM FROM 10 YEARS TO LIFE IN IMPRISONMENT. HOWEVER, AT MY SENTENCED, THE JUDGE GAVE HER REASONS IN OPEN COURT FOR HER DECISIONS AND SHE MADE THE FOLLOWING COMMENTS BEFORE SENTENCING ME TO LIFE IN PRISON:  “THERE ARE CASES IN WHICH A DEFENDANT BY HIS CONDUCT FORFEITS HIS RIGHT TO REMAIN IN SOCIETY. THIS CASE IS ONE OF THOSE.”
ANOTHER INAPPROPRIATE COMMENT.  HOW CAN ANY DEFENDANT FORFEIT HIS RIGHT TO REMAIN IN SOCIETY BY BEING CONVICTED OF A DRUG CHARGE???????????????????
ASIDE FROM THE JUDGE GIVEN ME AN UNREASONABLE LIFE SENTENCED FOR DRUGS ONLY, IT ALMOST SEEMS LIKE IF SHE’S VERY BIAS TOWARDS ME FOR WHATEVER REASONS AND THERE IS A 2009  2nd CIRCUIT CASE, THAT CAME FROM RIGHT OUT OF HER COURTROOM THAT PRETTY MUCH SUPPORTS MY CONCLUSION OF HER ACTIONS.
THE NAME OF THE CASE IS CALLED  “US v. ROBERT HERTULAR, 562, F.3d 433 (2nd CIR.2009).”  IT’S A CASE ABOUT A MAJOR DRUG DEALER WHO WENT TO TRIAL IN HER COURTROOM AND HE WAS FOUND TO BE CONVICTED OF THESE 4 COUNTS. (1).CONSPIRACY TO IMPORT 5 KILOGRAMS OR MORE OF COCAINE, 21 U.S.C.S. SECTION  952(a),963; (2) DISTRIBUTION OF FIVE KILOGRAMS OR MORE OF COCAINE, KNOWING THAT IT WOULD BE IMPORTED INTO THE UNITED STATES, 959 (a), 960(b)(1)(B)(ii); (3).FORCIBLY IMPEDING OR INTIMIDATING A FEDERAL OFFICER, 18 U.S.C SECTION 111; AND (4).OBSTRUCTION OF JUSTICE, SECTION 1512(b)(3).
THE TRIAL EVIDENCE CONVINCINGLY DEMOMSTRATED THAT IN THE PERIOD BETWEEN 2001 AND JANUARY 2004, BELIZEAN NATIONAL ROBERT HERTULAR CONSPIRED WITH OTHERS TO IMPORT MORE THAN  “6 TONS” OF COCAINE INTO THE UNITED STATES. FURTHERMORE, IN MID-2001, BELIZEAN AUTHORITIES CHARGED HERTULAR WITH TRAFFICKING IN  “1,161 KILOGRAMS OF COCAINE” WHICH DRUGS HERTULAR ADMITTED BELONGED TO HIM AND WERE DESTINED FOR THE UNITED STATES.
HERTULAR’S PRE-SENTENCE REPORT RECOMMENDED AN OFFENSE LEVEL OF “45″, WHICH WITH A CRIMINAL HISTORY OF 1, YIELDED A GUIDELINES SENTENCING RANGE OF “LIFE IMPRISONMENT.”
THE DISTRICT COURT DID NOT, HOWEVER, SENTENCED HERTULAR TO LIFE IMPRISONMENT.  AFTER HEARING FROM THE PARTIES AS TO HOW THE FACTORS SPECIFIED IN 18 U.S.C. 3553(a) SHOULD BE WEIGHTED, THE DISTRICT COURT DECIDED THAT A NON-GUIDE LINE SENTENCED WAS SUFFICIENT TO SERVE THE SENTENCING GOALS IDENTIFIED IN THE STATUTE.  ACCORDINGLY, THE DISTRICT COURT SENTENCED HERTULAR TO PRISON TERMS OF  “400 MONTHS”  ON EACH OF THE TWO DRUG TRAFFICKING COUNTS, 12 MONTHS FOR FORCIDING IMPENDING A FEDERAL OFFICER AND 120 MONTHS FOR OBSTRUCTION OF JUSTICE, ALL TERMS TO RUN CONCURRENTLY, (33-1/2 YEARS IMPRISONMENT.)
THIS DEFENDANT WAS SENTENCED TO 400 MONTHS, AFTER THE TRIAL EVIDENCE CONVINCINGLY DEMONSTRATED THAT HE CONSPIRED WITH OTHERS TO IMPORT MORE THAN  6-TONS  OF COCAINE INTO THE UNITED STATES AND YET, I WAS GIVEN A SEVERE LIFE SENTENCED ALL BECAUSE OF COOPERATING WITNESSES TESTIFYING FALSELY ABOUT DRUG QUANTITIES, FOR WHICH THE DISTRICT COURT CAME TO AN CONCLUSION THAT I DISTRIBUTED AN EXCESS OF 150 KILOGRAMS OF COCAINE. THIS IS AN AMOUNT THAT’S NOT ONLY UNTRUE, BUT THIS IS ALSO AN AMOUNT THAT’S ABSOLUTELY NO WHERE NEAR  “6-TONS”  OF COCAINE, FOR WHICH THE DEFENDANT WAS SENTENCED TO 400 MONTHS IMPRISONMENT.
HOW CAN ANYONE COMPARE  33-1/2 YEARS TO A CRUEL AND UNREASONABLE LIFE SENTENCED?????  OR BETTER YET, HOW COULD ANYONE POSSIBLY COMPARE  “150 KILOGRAMS OF COCAINE”  TO  “6-TONS OF COCAINE”, THAT WAS DESTINED FOR THE UNITED STATES??????  WHATEVER HAPPENED TO EQUAL RIGHTS OR EQUAL JUSTICE, AS WELL AS THE FAIRNESS AND THE RESPECT FOR THE LAW???????  IT’S NOT ONE LAW FOR ONE COLOR OR ANOTHER, IT’S NOT ONE LAW FOR THE RICH OR THE POOR, IT’S JUST ONE LAW.
I CAN HANDLE MY OWN RESPONSIBILITIES OF SERVING A PRISON SENTENCED FOR WHAT I HAVE DONE TO BREAK THE LAW.  HOWEVER, I WILL NEVER EVER BE ABLE TO EXCEPT SERVING A LIFE SENTENCED FOR POSSESSING OR DISTRIBUTING HUNDREDS AND HUNDREDS OF KILOGRAMS OF COCAINE OR EVEN CRACK COCAINE THAT I HAVE NEVER DEALT WITH BEFORE IN MY ENTIRE LIFE.
I AM VERY FAR FROM BEING A DRUG KINGPIN, I AM NOT A SERIAL KILLER, I AM NOT A RAPIST OR A CHILD MOLESTER AND YET, I HAVE BEEN SENTENCED AS IF I’M EITHER ONE, OR ALL OF THE ABOVE.
I AM NOT A MURDERER, NOR DID I EVEN GET CONVICTED OF ANY MURDERS AND USUALLY 95% OF MURDERERS GET LIFE IN PRISON.  I’M NOT SAYING THIS TO SAY THAT DRUG DEALERS SHOULDN’T GET PUNISHED FOR THEIR CRIMES, I’M JUST SAYING THAT DEEP DOWN INSIDE OF MY HEART ,I STRONGLY DON’T BELIEVE THAT I SHOULD BE GIVEN A LIFE EXTINGUISHING SENTENCED FOR DRUGS AND AS AN INDIVIDUAL, I AM NOT THE TYPE OF PERSON THAT DESERVES TO COME OUT OF PRISON IN A CASKET.

EVEN JUDGE HELLERSTEIN OF THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF NEW YORK HAS NOTED, THAT  “REHABILITATION IS A GOAL OF PUNISHMENT AND THAT GOAL CANNOT BE SERVED IF A DEFENDANT CAN LOOK FORWARD TO NOTHING BEYOND IMPRISONMENT.  HOPE IS THE NECESSARY CONDITION OF MANKIND AND A JUDGE SHOULD BE HESITANT BEFORE SENTENCING SO SERVERELY THAT HE OR SHE DESTROYS ALL HOPE AND TAKES AWAY ALL POSSIBILITY OF USEFUL LIFE.  PUNISHMENT SHOULD NOT BE MORE SERVERE THAN NECESSARY TO SATISFY THE GOALS OF PUNISHMENT.”   U.S. v. CARVAJAL, 2005 WL 476125 (S.D.N.Y. Fed. 22, 2005).  OTHER COURTS HAVE SIMULARLY FOUND THAT  “LIFE-EXTINUISHING” SENTENCES PROVIDED BY THE ONCE MANDATORY GUIDELINES, WERE UNREASONABLE.  SEE U.S. v. THOMAS, 360 F.SUPP. 2d 238 (2005).

I AM IN HERE FIGHTING SO VERY HARD FOR MY FREEDOM, BUT I AM JUST A PRO-SE LITIGANT WITH VERY LITTLE LEGAL SCHOOLING, WHICH MEANS THAT I CAN NOT NAVIGATE MY WAY THROUGH THE COMPLICATIONS OF CRIMINAL RULES AND PROCEDURES WELL ENOUGH TO GO UP AGAINST A CAREER PROSECUTOR.
BY MYSELF, I HAVE ABSOLUTELY NO WINS WITH THE COURTS WITHOUT ADEQUATE COUNSEL ON MY SIDE AND SIMPLY FROM THE LOOKS OF HOW THE PROCEDURE IS GOING FOR MY CASE, IT DOESN’T LOOK LIKE THE JUDGE IS EVER GOING TO GIVE ME A FAIR CHANCE AT GETTING ANY TYPE OF RELIEF ON ANY OF MY CLAIMS. SHE HAS ALREADY DENIED MY 2255 MOTION ON JULY 28, 2011 AND SHE ALSO DENIED MY C.O.A. 
IT’S LIKE THE FEDERAL COURTS DO NOT RESPECT THE VERY HARD WORK OF PRO-SE LITIGANTS AND IF WE DON’T HAVE ADEQUATE COUNSEL REPRESENTING US PRO-SE LITIGANTS, WE JUST DON’T GET ANY TYPE OF RELIEF ON ANY OF OUR LEGITIMATE LEGAL CLAIMS.

1.My name is Melody Mccully but the federal government knows me by #16386-045. I was arrested Sep 19th,2003 for
(21USC 841) conspiracy to distribute methamphetamine. I has a mandatory minimum of 10 yrs. April 22nd, 2004, three days before my 25th birthday, I was sentenced to 168 months in prison.
    I had never been in trouble before this case and have not been in trouble since. I accepted responsibility because I was guilty. I never denied that. I have had clear conduct and have taken every opportunity to rehabilitate myself with any class I could get into whether it was educational, psychological, or drug counseling. I have around 100 certificates. I have continued to do volunteer work also. I was on the front page of a newspaper for running the Susan G. Coleman race for the cure 5K in Pekin, Il in 2010. I am known and called “a role model inmate”.
    Did I deserve to be put in prison? Yes., I broke the law. Did I deserve 14 years? Some say I do, but I think it was too harsh for a first time non-violent offender. I have had to give my children up for adoption so they could have a better life( which I don’t regret) and even though I was allowed to furlough on the Greyhound (by myself) for 3 days, I was not allowed to attend my only living parent at the time, my mom’s funeral.
    Have I learned my lesson? Without a doubt. I have been the lowest possible custody level since 2007. I am in a prison camp that has no fences, that is overcrowded, two guards for over 600 inmates who are unfortunately cases a lot like mine (first time non-violent offenders)who could be put on probation or house arrest, be paying for that, working and paying taxes, and volunteering our time in the communality bettering it.
    The prison are so over-crowded. There are people that deserve to be here for long sentences but we need something more to help figure out which ones do and which ones don’t. There’s no money and most of our children are either in the custody of our parents or custody of the state(foster care), which also costs tax payers money.
    Something needs to change. There needs to be something, some programs like the extra good time(conduct) bill or parole. The Second Chance Act needs to be approved to help us continue to rehabilitate ourselves. This will give the prison system room to decide if one is worthy to be awarded for bettering themselves and doing the right thing, and the one’s that don’t won’t receive it

Prosecutor finally disbarred…

              A FEDERAL PROSECUTOR FINALLY DISBARRED

     In re Howes, DC. No 10-BG-938, (3/8/2012), Judge Anna Blackburne-Rigsby of the District
of Columbia Court of Appeals delivered the FIRST EVER  blow to Asst. U.S. Attorney G. Paul
Howes, disbarring him without waiting  for the Office of Professional Responsibility. 
A federal prosecutor is a lawyer, but no court has ever held them responsible. 
“We are further motivated to hold prosecutors accountable,”  The Court said.
 The DC Bar Counsel  learned about former AUSA Howe’s behavior from local newspapers and
launched its own investigation.  
Mr. Howe was giving away false witness vouchers, violating Statute 18 USC 1001 and 1018.
 He also failed to disclose evidence relating to these transactions.  There were 7 rules of
 Professional Conduct for Lawyers violated.  In my case, The AUSA also refuses to disclose,
violating 18 USC 3006, where my CJA appointed  defense attorney was also an elected
common Pleas Judge.  My complaint is pending with the Ohio Disciplinary Counsel, as well
as the 6th Circuit Court of Appeals.  This is the first time ever that the courts took action,
but I am hoping it is the start of fairness with AUSAs failing to disclose exculpatory evidence.

1.It always seems to amaze me when the “Great and all Knowledgeable” White Man makes the claim that they are locking up these individuals with “their” wonderful drug laws, because WE white people want you to know we are helping resolve “mostly these black on black” crimes by throwing your children into a Federal Prison for years, often decades behind bars…much of it for non-violent, CONSENSUAL crimes…although, they (white man lawyers/prosecutors) like to disguise this supposed assistance of theirs, as “black on black” crimes.

I wonder if this writer knows that the Federal Guidelines takes into consideration any act of violence, separately from the drug quantity? Come on, who is this clown fooling…next we’ll probably hear out of this guy, “Really I’m not a racist, one of my best friends are black”…..Ring any bells out there?

Federal Goodtime and Parole

1.I am in prsion serving a 22 year sentence for a non-violent drug crime that I did not commit. What makes my case extraordinary is that I have 100% documented proof, that a now notorious, prosecution team(AUSA Joseph W. Bottini and James A. Goeke were singled out in the Senator Ted Stevens Prosecutorail Misconduct Scandal) repeatedly committed misconduct and crimes to frame me.  My case was covered up by the very people whose job it is to correct such injustices. Since my incarceration my little sister, Rhonda jenice williams, my older sister, Natascha Marion Williams, and my first born son, Rolancio Alon Moss, passed away. My daughter, Teeonna Breanne King, has Sickle Cell Anemia. My son, Kyrell Williams, has arthrogryposis. These conditions can drastically shorten the life-span of those affected by it. I have been losing my eye-sight rapidly. The medical in prison is not the best. My children need their father, and I need my family and freedom. Please expedite a law paasing Goodtime or Parole. It would be to hard to correct the many injustices in the federal correctional system individually.

2012 special counsel Henry Schuelke released a 514 page report, investigating federal
prosecutor misconduct, stating “misconduct is widespread and varying among individuals.”
   On the same day, Senator Lisa Murkowski (R-Alaska) introduced the Fairness in
Disclosure of Evidence Act (S 2197), to provide uniform standards for prosecutorial
disclosure, and combat the specter of violations of Brady v Maryland, 373 US 83 (1963).
Submission of letters and essays along with public awareness is mandatory to assure
that this bill does not die.  It is a long-awaited ACT to equalize the unyielding power
of federal prosecutors.

The Biggest Cover Up n The Criminal Justice System

1.I am writing because there is much more to the story regarding the Senator Ted Stevens Prosecutorial misconduct Scandal. Special Proceedings, D.D.D., No. 1:09-mc-00198-EGS (report released 3/15/12) (New York Times, LA Times 4/8/09) The federal Prosecutors that were singled out for “repeated” prosecutorial misconduct has a history of misconduct that has been covered up , by local courts and court appointed attorneys. I am in prison with 100% documented proof that the prosecution repeatedly committed misconduct and crimes to frame me into a wrongful 22 year conviction and sentence. I have proof that I have alerted the Courts, Dept. of Justice, and the Bar Associations about the conduct of these same prosecutors to no avail, years BEFORE they were confirmed to be Corrupt an a special prosecutors investigation. 1.HI I am a federal inmate serving 2 life sentences for a non-violen “dry crack cocaine conspiracy”. I pursued trial on my attorney bad advice about my actual sentence exposer.  I had my case remanded back from the supreme court in 2000 under Apprendi v. New Jersey because the government indictment against me failed to allege any specific drug amounts that I should have been found guilty of if I had plead guilty .  By standing trial the jury was not requested to make any specific drug quantity findings .  Under the conspiracy the government requested the court to sentence me to relevant conduct findings by the preponderance of the evidence of the government’s co-opperating witnesses.  The court sentence me to the amounts of 21 kilograms of crack cocaine which carried 360 to life, then the government requested that I receive and additional enhancements pursuing trial and taking the stand in my defense , denying all  allegations of the charges bought against me and by being the person from out of the state that I was tried to stand trial .. I was enhanced for being a leader and superviser also for possessing a firearm which arrived frome hearsay testimony proffered by co-opprating government witnesses. My attorney did not file my Apprendi issues on my direct appeal ,so my life sentence was reinstated/affirmed by the appellant court.  I have an application for executive clemency pending with the office of the pardon attorney in D.C .. I have been incarcerated almost 14 years and never incured any incident/disciplinary report. I have 84 class certificates ( in house) and 3 college certifications at this point but I”m working on my art degree in paralegal studies.. I have requested under the Apprendi law and the 5th and 6th Amendment to the U.S. Constitution because I was not indicted or given notice for the offense that I have been charged a departure by the president pardon broad to commute my sentence to 20 years and leave the 10 years probation…I would appreciate any help from the public  Ricky Marcus Curry 09857-021

1.The world needs to know that we as a people that are incarcerated are all bad and that there is some os us that have families out there that are suffering just well as we are in here, mores, that some of us here are trying to very hard
to have the concerned to notice that we are living as a citizen in an inner secular society with hopes to one day return
to society to live as a citizen, but the question is; ‘will society accept us as a citizen or just treat us as a felon or criminal?’
The concern is very much important and I know  that some of us get back in society and show their not ready, and some
have real metal issues that go undetected because the in charge psychology department is not earning their pay, so these
serious problems go undetected.  We need responsible staff in these prisons that are willing to earn their pay by doing their
job in a very professional manner, that shall lead to some success when it comes to dealing with our mentally challenged
prisoners.
The reality is that the economy has a lot of people in employment positions that are pulling their part and are getting free
money so to speak and I believe that a closer look must be taken in to, not only our justice system, but the very people
employed in corrections as well.  This system needs an enema.

1.There is a major cover up in Anchorage Alaska regarding the Senator Ted Stevens Prosecutors. There is also a culture of corruption that enboldened these prosecutors to cheat in the prosecution of a sitting US Senator. I have been begging the Dept. of Justice to investigate these same prosecutors for years. Now that a special prosecutor has concluded that these prosecutors are corrupt, when is the DOJ going to review other defendants that were framed by these corrupt prosecutors. My little sister, Rhonda Jenice Williams, my older sister, Natascha Marion Williams, and my first born son, Rolancio alon Williams, have all died since my 6 years of incarceration for a crime I did not commit. My daughter has Sickle Cell Anemia and has received two blood transfusions in March 2012. A federal prosecutor has committed suicide, apparently because his stellar reputation was ruined by the prosecutorial misconduct committed by my prosecutors. My case is still being covered up. Please get the word to the public. To be in prison with 100% documented proof you were framed by notoriously corrupt prosecutors and the judges and court appointed attorneys are covering it up is torture, and I have proof of all of it. I even have documents that prove that I was so frightened by the corruption in Anchorage that I sent e-mails to my attorney and filed an injunction with the court saying that they may use an airplane crash to get rid of me or my evidence. 1.I have a classic case of a conspiracy to violate adefendants constitutional right’s and a conspiracy to conceal those violations. the dist court is a willing participant along with the prosecutor and the court appointed attorney. It’s hard to complain to the Judge that’s directing the misconduct. The third attorney appointed went as far as altering my phone records in an effort to conceal the conflict of interest and Prosecutorial Misconduct, which i could do by identifying the informants phone no.# then subpoenaing those records to show his communications with the attorney appointed by the district court to represent me. After this attny facilitated the investigation of me through my alleged friend. this case is identical to United States v. Marshank, 777 f.supp 1507 (9th cir. 1991)and comparable to United States v. Levy, 577 f.2d 200 (3r cir.N.J.1978),United States v. Schell, 775 f.2d 559 (4th cir. 1985).  Thus ensued the method of cover-up by the district court and it’s officer’s. I wrote up a contract stateing that he would provide the assistance required by the U.S. Const. and he states I  will not sign that I am an officer of the court. However he turns around and alter’s my phone records to conceal the conflict of interest inwhich the cour failed to notify me in open court of the conflict of interest prior to the appointment of this counsel. I can prove this with the appropriate records, however the district court has blocked access to the records and allowed counsel to submit records that fail to comply with Title 28 U.S.C. sec. 1732 of judiciary and judicial procedures these records were not prepared by T-Mobile in the regular course of business. The records are a fraud which were prepared by my counsel to divert my claims. He claimed not to be the one to throw a member of the bar assoc. under the bus. However, the evidence will show he crawled under the bus.

It makes one wonder why it’s so hard to get attention on cases in the poor and minority community, which face this sort of conduct from the courts, prosecutors and the attorney’s appointed to represent them. 1.I was 23 years old ,now i’m 36 years old,because i had 50.5 grams of crack cocaine,and 1 prior conviction I receive 20 years in prison,and 10 years supervise realase. Before commencement of trial the United States filed “Information to Estabilsh Prior Conviction” pursant to 21 u.s.c 851(a)(1) thus purporting to trigger the enhanced penalties under 841(b)(1)(a) which are a minimum of 20 years imprisonment and a maximum of life.
My only argument is why! would they use a prior conviction when i was a juvenile at the time,I completed 4 years in state for a new charge that i caught,while on probation.So i guess it’s fair to say,I’m doing time for a juvenile charge,and nothing else ,because if i did not have that juvenile drug charge I would have been home already.so tell me is that fair for anybody,

Hello i don’t know if you read any of these e-mails but i had to comment on a part one of your piece’s's today.
The reason why some of the staff in the B.O.P don’t do what they can to help people get home (even when they are sickly)is because ,(some staff not all) feel as though its JOB security when we have to stay locked up .Look at the number of petty assaults on staff. How many do you think are provoked by staff them salve’s? Yes there are some assaults that are done to staff that are not there fault ,an yes there are some good staff member’s (yes some one doing time said that, We are not
all bitter people like some would have the public think!) Anyway even when there is  a compassionate reason to try an help some one get home the first though that comes to mind is there JOB .Even though there’s more people coming in an OUT of jail on a daily basis. Why does so much wrong go on in the criminal justice system ? That’s an easy question to answer.
PERSONAL GAIN IN THE WORK PLACE!!!!! 

 I might not have gotten my point across without sounding like im talking conspiracy theories’ ,But” what im saying
plays a major part in the decision’s that people make when dealing with other people’s live’s.An even though its morally
wrong no one will ever tell you that’s the reason for some of the move’s they make. They will always take the high ground

      Peter W. Hall of the Second Cir. Court of Appeals is a fraud, along with  Judges Robert D. Sack, and Amalya L Kearse and committed fraud on the court in U.S. v. Ware, 07-5222-Cr, 09-0851-Cr, 11-2151-Cr, (the “Appeals”),  by preventing Mr. Ware from appealing in a criminal case claiming the dismissal due to 11 USC 362(a) of the appeal in 03-7973-CV (2d Cir.), a civil case, was collateral estoppel in U.S. v. Ware, 04-Cr-1224(RWS)(SDNY), (“1224″); and then claimed law of the case prevented the indictment in 1224 from being dismissed. 

Citing  U.S. v. Ben Zvi, and U.S. v. Quintieri, two inapposite cases applying to later stages of the same case, (emphasis added to “same”.
